Federal Estate Planning
We handle all areas of Federal Estate Planning, including the creation of Irrevocable Trusts, such as Insurance Trusts, Residence Trusts for vacation homes and or primary residences, Dynasty Trusts, (Intentionally Defective Grantor Trusts) to capture assets which will be removed from your personal estate and therefore not subject to Federal Estate Taxation. Additionally, we create Revocable Trusts that may be modified in any fashion by you (the Grantor) at any time and protect the assets from creditors while dramatically reducing Probate expense. Additionally, we prepare Health Care Proxies and Durable Powers of Attorney.
New Jersey Estate Planning
We also handle New Jersey Estate Planning to protect those with assets in excess of $675,000.00 and are residents of this state. New Jersey Estate Planning may incorporate Revocable Living Trusts to minimize Probate expense as well as protect assets from creditors’ claims. When appropriate, we utilize Irrevocable Trusts to remove assets from our individual name and permit effective generation skipping as well as utilize Durable Powers of Attorney and Health Care Proxies.
Federal and New Jersey Probate
The process of Probate commences at the moment of death and represents the marshalling or gathering of assets and honoring all estate liabilities. The process of probate continues until New Jersey and or Federal Government approval is received which permits the distribution of assets per the terms of the Last Will and Testament and or any Inter Vivos or Testamentary Trusts. During Probate we complete the Internal Revenue Service Estate Tax form 706 in addition to the New Jersey Estate Tax Return and the New Jersey Inheritance Tax Return.
New Jersey Residential Real Estate
We practice residential real estate from the commencement of Attorney Review, if the transaction is negotiated with the help of a realtor, or by the drafting of contracts for the purchase and or sale of real property. We draft appropriate riders to modify contracts, prepare all closing documents including negotiating with various lenders (banks), address inspection issues and obtain the appropriate title search and insurance. We personally represent you at every stage of the real estate closing transaction including the actual "closing" process at which time you will achieve ownership or sale of the real property.
New Jersey Commercial Real Estate
We practice commercial real estate commencing with the drafting of contracts after a Letter of Intent is executed by all parties. We personally address all inspection, environmental, health, and government issues during the "due diligence" period. We complete the commercial transaction including negotiating with the lender (bank) as well as prepare all documentation to permit the purchase or sale of the commercial property. We obtain the appropriate real estate search as well as obtain the necessary title insurance policies. We personally appear at the closing table to be sure all obligations of the transaction are completed as per the terms of the contract between the parties.
